Agreement to Terms

By accessing or using the Underwood K9 website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

Services & No Guarantee of Results

Underwood K9 provides professional dog training services based out of Joppa, Alabama, including in-home private lessons, board-and-train programs, boarding stays, and behavior modification (including aggression rehabilitation).

Payments, Deposits & Refund Policy

• 50% Deposit Due Upfront: A non-refundable deposit is required to secure your booking dates. This deposit is forfeited if you cancel.
• 50% Remaining Balance: The remaining balance is due upon completion of the service (e.g., pickup of your dog for Board & Train, or at the end of a private lesson).
• All payments are processed securely through Stripe. We never store your full card number on our servers.
• Prices are subject to change, but confirmed bookings will be honored at the agreed price.

Rescheduling, Cancellations & No-Shows

• Rescheduling: You may reschedule with at least 48 hours' notice. Your deposit transfers to the new date. A maximum of two reschedules are allowed per booking.
• Cancellations: If you cancel for any reason, the deposit is forfeited.
• No-Shows: Failure to arrive within 15 minutes of your scheduled start time constitutes a "No-Show," resulting in forfeiture of the session and deposit.

Client Responsibilities & Aggression Disclosure

As a client, you represent and warrant that:

• Full Disclosure: You have truthfully disclosed any history of aggression, biting, or behavioral issues. Failure to do so may result in immediate termination of services without refund.
• Active Participation: You understand that your participation and homework compliance is required for success.
• Vaccinations: Your dog is current on Rabies, DHPP, and Bordetella vaccinations. Proof of vaccination from your veterinarian is required before services begin.
• Health: Your dog is healthy and free from contagious diseases, parasites, or illness.
• Medications: You have disclosed any known health conditions or medications your dog is on.

We reserve the right to refuse service or send a dog home if these requirements are not met.

Assumption of Risk & Liability Waiver

Please read carefully: By using our services, you hereby release, waive, discharge, and covenant not to sue Underwood K9, its owners, employees, agents, and representatives from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, your dog, or any third party.

• You assume full responsibility for any and all injuries or damages caused by your dog to any person, animal, or property.
• You agree to indemnify and hold harmless Underwood K9 from any claims, damages, or legal costs arising from your dog's behavior or your breach of these terms.
• In the event your dog requires emergency veterinary care while in our care (e.g., during Board & Train or Boarding), you authorize us to seek treatment at your expense.

Training Methods

Underwood K9 uses balanced training methods that may include positive reinforcement, corrections, and the use of training tools such as e-collars, prong collars, and slip leads. By enrolling in our program, you consent to the use of these methods and tools as deemed appropriate by our trainers for your dog's training.

Photo and Video Release

By using our services, you grant Underwood K9 permission to photograph and video record your dog during training sessions. These materials may be used for training documentation, marketing, social media, and our website. If you do not wish for photos or videos to be used publicly, please notify us in writing before service begins.

User Accounts

You may create an account on our website to manage bookings, view order history, and save dog profiles. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these terms or are used for fraudulent purposes.

Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Underwood K9 and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Limitation of Liability

To the maximum extent permitted by law, Underwood K9 shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services. Our total liability for any claim arising from these terms or our services shall not exceed the amount you paid for the specific service giving rise to the claim.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts of Alabama.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to this website. Your continued use of our services after any changes constitutes acceptance of the new terms.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.
